The rules of the road.

These Terms & Conditions (“Terms”) form a binding agreement between you (“User,” “you”) and NeuroCalm AI, operated by Kartikeya Mishra from India (“we,” “us,” “our”). By downloading, installing, or using the NeuroCalm AI mobile application or website (collectively, the “Service”), you accept these Terms in full.

1. Eligibility

You must be at least 18 years old to use NeuroCalm AI. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into this agreement.

2. What NeuroCalm AI is (and is not)

NeuroCalm AI is a wellness and self-reflection tool. It combines on-device AI, guided cognitive behavioral exercises, journaling, and calming audio to help you track and manage your emotional state.

NeuroCalm AI is not a medical device, a licensed therapist, a substitute for professional mental health care, a diagnostic tool, or an emergency service. The content provided through the Service is for general informational and wellness purposes only.

3. Account and access

Certain features require creating an account or purchasing a premium plan. You agree to:

• Provide accurate, current, and complete information.
• Keep your login credentials confidential.
• Notify us immediately of any unauthorised use of your account.
• Be responsible for all activity that occurs under your account.

4. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code from the app.
• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Attempt to gain unauthorised access to our servers or other users’ data.
• Resell, sublicense, or redistribute the Service without written permission.
• Use the Service to harass, abuse, or harm yourself or others.
• Circumvent any paywall, subscription control, or feature limitation.

5. Subscriptions and payment

NeuroCalm AI offers a free tier and paid premium plans. Subscription pricing, billing cycles, and included features are displayed at checkout and are subject to change with prior notice.

• Payments are processed through Razorpay, an RBI-licensed payment gateway.
• All prices are in Indian Rupees (₹) unless otherwise stated and are inclusive of applicable GST.
• Recurring subscriptions renew automatically at the end of each billing cycle until you cancel them from your account settings.
• All payments are final and non-refundable. Please read our full Refund Policy before purchasing.

6. Intellectual property

All content, code, design, trademarks, and audio in the Service are the exclusive property of NeuroCalm AI or its licensors and are protected by Indian and international copyright laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes only.

Your journal entries, voice inputs, and mood data remain entirely yours. We claim no ownership over content you create inside the app.

7. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the AI insights will always be accurate.

8. Limitation of liability

To the fullest extent permitted by law, NeuroCalm AI and its operator shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Service.

Our total aggregate liability to you, for any claim arising from or related to the Service, shall not exceed the amount you have paid to us in the six (6) months immediately preceding the claim, or ₹1,000 — whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless NeuroCalm AI, its operator, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms. You may stop using the Service at any time. On termination, any outstanding payment obligations and the limitations above will survive.

11. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Meerut, Uttar Pradesh, India.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be announced in-app and on this page at least 14 days before they take effect. Continued use of the Service after that period constitutes acceptance of the updated Terms.
